Information on the Processing of Personal Data

Pursuant to Article 13 of the EU Regulation 2016/679 on the protection of personal data and the Code on the protection of personal data, Legislative Decree No. 196/2003, in the parts not in conflict with the aforementioned Regulation, as long as in force.

PRIVACY POLICY - INTRODUCTION

This information notice describes the methods and purposes of the processing of personal data (hereinafter referred to as ‘Data’) of Users who consult, register, use, or purchase the Services of the FACT MANAGEMENT SRL website accessible at https://www.hotelsolemareischia.it.
Data processing consists of any operation concerning: collection, recording, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, deletion.

DATA CONTROLLER, DATA PROCESSORS AND PERSONS IN CHARGE OF PROCESSING

The Data Controller of Users' Data collected through the Website is the Company FACT MANAGEMENT SRL (hereinafter FACT MANAGEMENT SRL), with registered office in VIA BAIOLA - 80977 - ISCHIA - NA, eMail info@hotelsolemar.it. Data processing takes place mainly at the headquarters and offices of the Company FACT MANAGEMENT SRL, at external companies, in any case within the EU, and is carried out by staff, employees and collaborators of FACT MANAGEMENT SRL expressly appointed for this purpose. FACT MANAGEMENT SRL may also avail itself, for the performance of the processing in question, of third parties (by way of example but not limited to: consultants, accountants, lawyers) to whom the Data shall be made accessible or communicated, who shall act as autonomous data processors or controllers.

DATA PROCESSING

In accordance with the provisions of Article 4 GDPR, the processing of Data carried out by FACT MANAGEMENT SRL consists of any operation or set of operations, carried out with or without the use of automated processes and applied to personal data or sets of personal data, of collection, adaptation, modification, extraction, consultation, recording, organisation, communication, comparison, interconnection, limitation, structuring, storage, use, deletion and destruction.

TYPE AND PURPOSE OF DATA PROCESSED

FACT MANAGEMENT SRL only processes personal data and does not intend to collect and process special personal data (defined as sensitive), i.e. data that may reveal an individual's racial and ethnic origin, state of health and sex life, religious, political and philosophical beliefs and adherence, and therefore does not intend to collect and process biometric, genetic and judicial data.

BROWSING DATA

During consultation of the Site, the computer systems and applications used to operate the Site collect, in the course of their normal operation, certain personal data, implicitly transmitted in the use of Internet communication protocols, which cannot be immediately associated with identified users, but which, through processing or association with data held by third parties, could allow the identification of visitors to the Site (e.g. IP address of the system used for connection). This data is processed for the time strictly necessary for the sole purpose of receiving information relating to telematic traffic and used to check the proper functioning of the site, after which it is usually removed from the system and stored off-line for the sole purpose of ascertaining possible computer crimes and can only be consulted at the request of the judicial authorities.

DATA PROVIDED BY THE USER SPONTANEOUSLY

FACT MANAGEMENT SRL processes Data that the user/visitor provides during navigation (see Navigation Data). Pursuant to Article 6 letters b) and c) of the GDPR, FACT MANAGEMENT SRL shall also use the Personal Data acquired for the following purposes: legal compliance. The user, provided that he/she proves to be the data controller, may at any time object to the aforementioned processing, asking FACT MANAGEMENT SRL to delete the data collected and traceable to his/her IP address.
Nature of data provision

Apart from what has been specified for browsing Data, the provision of Data through the forms on the Site, or communications sent on a voluntary basis by the User himself/herself (by way of example but not limited to: optional sending of one's e-mail address), is always optional in nature. Nonetheless, some of the Data requested, in particular the identification data necessary to purchase and use the services, is mandatory, and in the event that such Data is not provided, FACT MANAGEMENT SRL cannot and will not be able to provide the User with the requested service.

TREATMENT MODALITIES

Personal data, in accordance with Article 5 of the GDPR, are processed lawfully and fairly, both on paper and by automated means, for a period of time not exceeding that necessary for the purposes for which they were collected:
.- to fulfil any obligations under applicable laws, regulations or EU legislation, or to comply with requests from judicial authorities.
.- responding to specific requests (2 years), for the construction of a FAQ database.
.- browsing the Site (3 years);
FACT MANAGEMENT SRL takes all security measures to protect the data collected, in order to prevent loss or theft of data, unauthorised access, illegal and incorrect use.

PURPOSE OF PROCESSING

In detail, the Data will be processed for:
.- fulfilling any obligations under applicable laws, regulations or EU legislation, or fulfilling requests from competent authorities
.- allow navigation on the site
.- respond to specific requests addressed to FACT MANAGEMENT SRL
Use of cookies

Cookies are small text files that may be deposited on the User's computer by the website being explored to allow efficient navigation of the site and to monitor usage (accesses and pages viewed, in particular), and in order to be able to make improvements in terms of usability, operation, navigation and performance of any services. FACT MANAGEMENT SRL uses its own and third-party technical cookies that can be disabled.

RIGHTS OF THE DATA SUBJECT

FACT MANAGEMENT SRL guarantees that you can exercise your rights under the GDPR at any time:
.- the deletion of personal data held by the Controller if one of the grounds provided for in the GDPR applies (Art. 17 GDPR - Right to Deletion)
.- to request the Controller to limit processing to only certain personal data, if one of the grounds provided for in the Regulation applies (Art. 18 GDPR - Right to restriction of processing)
.- to know whether the Controller holds and/or processes personal data relating to you and to have full access to them, including by obtaining a copy (Art. 15 GDPR - Right of access)
.- rectification of inaccurate personal data or supplementation of incomplete personal data (Art. 16 GDPR - Right of rectification)
.- to request and receive all your personal data processed by the controller, in a structured, commonly used and machine-readable format, or to request transmission to another controller without hindrance (Art. 20 GDPR - Right to Portability)
.- to object in whole or in part to the processing of data for the purpose of sending advertising material and market research (Art. 21 GDPR - Right to object)
.- to object in whole or in part to automatic or semi-automatic data processing for profiling purposes. (Art. 22 GDPR - Right to object to automated processing)
Methods of exercising Rights

The User may exercise his/her rights at any time by sending a registered letter with acknowledgement of receipt to FACT MANAGEMENT SRL to the above address, or by sending an eMail to info@hotelsolemar.it.
